These Terms and Conditions ("Terms") govern your access to and use of the website, programs, coaching services, and app provided by 316 Wellness Services Limited ("316," "we," "us," or "our"). By using our website or purchasing a program, you agree to these Terms. If you do not agree, please do not use our services.
316 offers fitness and nutrition coaching delivered in person and online, structured programs such as the 316 Method, and a mobile app (once available). The specific features and inclusions of each program are described at the time of purchase.
You must be at least 18 years old to purchase our services on your own behalf. A minor may participate only with the consent and involvement of a parent or legal guardian, who accepts these Terms on the minor's behalf.
Our coaching, programs, and content are for general fitness and educational purposes and are not medical advice, diagnosis, or treatment. Consult your physician or a qualified healthcare provider before beginning any exercise or nutrition program, especially if you have a medical condition, are pregnant, or are taking medication. Exercise and dietary changes carry inherent risks. By participating, you acknowledge these risks and agree that you take part voluntarily and at your own risk. Stop and seek medical attention if you experience pain, dizziness, or other symptoms.
Results vary from person to person and depend on many factors, including your effort, consistency, and individual circumstances. We do not guarantee any specific outcome, and testimonials reflect individual experiences rather than promises of results.
Prices are listed in Canadian dollars (CAD) unless stated otherwise. Payments are processed securely through our third-party payment processor (Stripe). For subscription-based access, such as the 316 app, you authorize recurring charges until you cancel in accordance with the cancellation terms provided at sign-up. You are responsible for keeping your payment information current.
Refund and cancellation terms for each program are provided at the time of purchase. We encourage you to book a free consultation before purchasing to make sure the program is the right fit. If you have questions about a specific purchase, contact us and we will do our best to help.
All content provided through our website, programs, and app, including the 316 Protocol, training and nutrition materials, text, graphics, logos, and videos, is owned by or licensed to 316 and is protected by intellectual property laws. It is provided for your personal, non-commercial use. You may not copy, redistribute, resell, or share your access with others without our written permission.
You agree to use our services lawfully and respectfully, and not to misuse the website or app, interfere with their operation, attempt unauthorized access, or share another person's account. We may suspend or terminate access for conduct that violates these Terms.
We rely on third-party services such as payment processing, email delivery, and app distribution platforms. Your use of those services may be subject to their own terms and privacy policies, and we are not responsible for their practices.
Our services are provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. To the maximum extent permitted by law, 316 and its owners and coaches will not be liable for any indirect, incidental, or consequential damages arising from your use of our services. Nothing in these Terms limits liability that cannot be limited under applicable law.
You agree to indemnify and hold harmless 316 and its owners and coaches from any claims, losses, or expenses arising out of your use of our services or your breach of these Terms.
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of our services after changes take effect means you accept the updated Terms.
